Terms of Service

1. Agreement to these terms

These Terms of Service (the “Terms”) govern your access to and use of the Mapteek website, editor, and related services (together, the “Service”), and every purchase you make through them. Mapteek (“Mapteek”, “we”, “us”) sells custom map posters that you design in our online editor and that our production partners print and deliver. By using the Service or placing an order you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old and legally capable of entering into a binding contract to place an order. By ordering, you confirm that the information you provide — including your shipping address and email — is accurate and yours to use.

3. The Service

The editor lets you search any place, style a map in our themes, preview the result live, and order it as a printed poster. Some features (such as AI-assisted theme suggestions) rely on third-party services and may change, be interrupted, or be withdrawn at any time. We may update, add, or remove features of the Service without notice; this never affects an order you have already paid for.

4. Orders, acceptance & cancellation

Your order is an offer to buy. It is accepted when payment succeeds and we send an order confirmation email, at which point a contract for that order is formed. We may refuse or cancel any order — for example for suspected fraud, a pricing or listing error, content that violates Section 9, or a fulfillment problem — in which case we will refund you in full. Because production starts quickly, we cannot guarantee changes or cancellations after an order is placed; contact us immediately at orders@mapteek.com and we will do what we can.

5. Prices, payment & taxes

Prices are shown in the editor and at checkout in US dollars and can change at any time before you order. Payment is processed by Stripe on Stripe-hosted pages; we never see or store your card details. Displayed prices include the product and, where stated, shipping. Sales tax or VAT is applied where required. For international deliveries, import duties, customs fees, and local taxes levied at the border are your responsibility unless stated otherwise at checkout. In the event of an obvious pricing error, we may cancel and refund affected orders.

6. Custom products — check your design

Every poster is made to order from the exact map area, theme, size, framing, and text you chose. What you see in the editor preview is what gets printed. Please verify spelling, the framed map area, and coordinates before purchasing. Minor variation between screen colors and printed colors is inherent to printing and is not a defect. Map data comes from third-party sources and may contain inaccuracies or omissions; the poster is a piece of art, not a navigational tool.

7. Shipping, delivery & risk of loss

Production times, carriers, and delivery estimates are described in our Shipping & Returns policy. Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you on delivery to your address. You are responsible for providing a complete, accurate shipping address; orders returned or lost because of an incorrect address may require a paid reprint.

8. Returns, defects & refunds

Because each print is custom-made for you, we do not accept change-of-mind returns. If your poster arrives damaged, defective, or materially different from your design, email us photos within 30 days of delivery and we will reprint it or refund you — your choice. Refunds go to the original payment method. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer, including any statutory withdrawal rights that apply to non-personalized goods in your country (custom-made posters are generally exempt from EU/UK withdrawal rights, as permitted by law).

9. Your content

You can place custom text on your poster (for example a heading or a dedication). You retain your rights in that text and grant us a non-exclusive, worldwide license to reproduce it solely to produce, fulfill, and support your order. You represent that your text does not infringe anyone’s rights and is not unlawful, hateful, harassing, or defamatory. We may refuse or cancel (with a full refund) any order whose content we reasonably believe violates this section.

10. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • scrape, crawl, or bulk-generate posters or previews by automated means, or resell output of the editor without our written permission;
  • interfere with or disrupt the Service, probe or test its vulnerabilities, or circumvent any usage or rate limits;
  • reverse engineer, copy, or create derivative works of the Service, its themes, or its design, except where law permits;
  • misrepresent your identity or payment authority when ordering.

We may suspend or terminate access to the Service for violations of this section.

11. Intellectual property

Map data is derived from OpenStreetMap, © OpenStreetMap contributors, used under the Open Database License (ODbL). The Mapteek name, logo, website, editor, and theme designs are owned by us or our licensors and are protected by intellectual-property laws. A poster you purchase is yours to display, gift, or enjoy privately; purchasing it does not transfer any rights in the underlying themes or the Service, and does not permit commercial reproduction or resale of editor output without our written permission.

12. Third-party services

The Service depends on third parties — including Stripe (payments), Gelato (printing and delivery), OpenStreetMap/OpenFreeMap (map data and tiles), and Google (hosting and AI suggestions). Their availability is outside our control, and your use of Stripe’s checkout is also subject to Stripe’s own terms. We are not responsible for third-party services except as reflected in our obligations for your order under these Terms.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MAP DATA IS ACCURATE OR COMPLETE. THIS SECTION DOES NOT LIMIT THE PRODUCT REMEDIES IN SECTION 8 OR ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER; (B) OUR TOTAL LIABILITY FOR ANY OTHER CLAIM RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED US DOLLARS (US$100); AND (C) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW — INCLUDING LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE — OR YOUR NON-WAIVABLE CONSUMER RIGHTS.

15. Indemnification

You will indemnify and hold us harmless from claims, damages, and reasonable costs (including legal fees) arising from text or content you place on a poster, your violation of these Terms, or your misuse of the Service — except to the extent we caused the issue.

16. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control — including natural disasters, fires, floods, power or network outages, strikes, carrier disruptions, pandemics, war, government action, security incidents, or failures of our suppliers. If such an event prevents us from fulfilling your order within a reasonable time, either of us may cancel it and we will refund you in full.

17. Governing law & disputes

If something goes wrong, talk to us first — email orders@mapteek.com and we will try in good faith to resolve the issue within 30 days; most problems end with a reprint or a refund. These Terms are governed by the laws of the jurisdiction in which Mapteek is established, without regard to conflict-of-law rules, and disputes that cannot be resolved informally belong to the courts of that jurisdiction — except that if you are a consumer, you keep any right to bring proceedings, and to rely on mandatory consumer protections, in the country where you live. Each of us agrees to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, to the extent such a waiver is permitted by the law that applies to you.

18. Changes to these Terms

We may revise these Terms as the Service evolves. The date above always reflects the current version, and material changes will be noted on the site. Changes apply prospectively: an order is governed by the Terms in force when you placed it, and continued use of the Service after changes take effect constitutes acceptance.

19. General

  • Severability. If any provision of these Terms is held invalid or unenforceable, that provision is limited or removed to the minimum extent necessary and the rest remains in full force.
  • No waiver. Our failure or delay in exercising a right under these Terms is not a waiver of that right, and a single or partial exercise of a right does not prevent its further exercise.
  • Assignment. You may not assign these Terms or an order without our written consent. We may assign our rights and obligations — for example to a successor of the business — provided your order rights are unaffected.
  • Entire agreement. These Terms, the Privacy Policy, and the Shipping & Returns policy are the entire agreement between you and us about the Service, and supersede prior discussions.
  • Survival. Sections that by their nature should survive (including 9, 11, and 13–17) survive completion of an order and any termination of the Service.
  • Electronic communications. You consent to receive order-related communications from us electronically, at the email address you provide.
